Terms and Conditions
Client agrees to pay photographer a good-faith deposit at the time of booking to secure their appointment date and time. This is a non-refundable retainer fee. The retainer is included with the total price of your package and will be credited to the total amount owed for photography Session Fee. If for any reason the event time and date changes after the submittal of the retainer, Trish Meadows Photography will do its best to accommodate those changes. However, any such accommodations are based on the availability of the photographer for the new date and time. Any cancellations after the signing of the contract and retainer payment will result in the retainer not being refunded. The balance of the event package (final payment) is due 72 hours (3 days) prior to the event.
Location Costs & Fees
If there are any costs/fees associated with the location the client has chosen for the session, you, the client, will be responsible for those fees. If client selects location, you must have obtained legal access to location in advance of the photo session. The photographer will not guarantee or arrange payment on any location. Session Fee covers travel within 50 miles of Jersey,GA. Any location outside of these limits will be subject to an additional charge of $.60/mile as part of the agreement. If lodging is needed in order to photograph an event (i.e. wedding), one or two nights of lodging at a Marriot, or nicer, is at the client's expense.
If an illness or situation prevents a photo session from taking place, client may reschedule their session at least 24 hours prior to their shoot without penalty. Should client fail to give 24 hours’ notice, or decide to completely cancel the shoot, the Session Fee is forfeited and will not be refunded. Photographer reserves the right to reschedule due to illness, weather, equipment malfunction, or other circumstances beyond her control.
Re-shoots are determined at the discretion of the photographer. Re-shoots will not be given for poor choices of clothing, make-up, hair or weather related issues, uncooperative children or by refusing to follow the recommendations of the photographer.
Proofing of client’s images will be available for viewing within 2-3 weeks of session date in a password-protected web-gallery. The number of shutter clicks during the session in no way indicates the number of photos in the proofing gallery. Refer to your session type as to how many proofs to expect. All images deemed not up to the photographer's standard of quality and vision are deleted immediately.
Photographer is committed to using high quality products. However, Client is aware that color dyes, inks, and other materials, used in photography may fade or discolor over time. As such, Client releases Photographer and his/her contractors, and representatives, from any liability for any claims, damages, or costs, arising from any fading or discoloration of any photographic prints.
All images will be available for ordering for two (2) weeks following client viewing date. After one (1) month, all images will be removed from photographer’s hard-drive, except as needed for promotional purposes, to be determined by photographer at photographer’s sole discretion. Originals and edited images are stored on an external hard drive and online backup cloud system. Photographer is not responsible for loss or damage to the digital files due to circumstances beyond photographer’s control.
It is understood that Trish Meadows Photography shall be the exclusive photographer retained by the client for the purposes of photographing contracted events from beginning to end. Family and friends of the client shall be permitted to photograph the event as long as they do not interfere with the Photographer's (Trish Meadows) duties.
Trish Meadows Photography will only coordinate with or take instructions from the client and/or the client's designated coordinator. It will be client's responsibility (or client's coordinator) to ensure that Trish Meadows Photography be allowed, without interruptions from other photographers, to take assigned photographs.
Liability for Capture of Specific Images
Photographers representing Trish Meadows Photography will do their best to capture all agreed upon photos of your event. However, due to limits imposed by time and flow of the schedule on event day, Trish Meadows Photography cannot be held liable for unintentional errors on the part of its photographers. Photographer may substitute another photographer to take photographs in the event of photographer's illness or other uncontrollable conflict. In the event of such substitution, Trish Meadows Photography warrants that the photographer taking the photographs shall be a competent professional.
All payments are due in full unless payment arrangements have been made. Orders will not be processed until payment in full is received. If client has arranged a payment plan, orders will be placed after the final payment has been received. Credit cards are accepted but a convenience fee of 2% may be added to purchases. Payments can also be made in the form of cashier's check, money order, personal check, or cash. Payable to Trish Meadows Photography.
If it is determined that you are entitled to a refund (excluding the retainer), it will done in a timely manner. You will surrender all images in all forms back to Trish Meadows Photography. All copies of the images will be destroyed. The original images will be kept on file for one year. You will not have any legal right to display, share or store the images digitally, in print or any other form. All right will revert back to Trish Meadows Photography.
Photographer is not responsible for the damage of portraits after ordering by client, including damage caused during transit by US mail. Client assumes all responsibility for the safety of all portraits upon receipt. All portraits sent via USPS can be insured and require delivery confirmation upon client’s request and at client’s expense.
Photographer kindly request that all clients sign the model release so that photographer may display the images from their session on photographer’s website, company Facebook page, and for using for marketing/promotional/advertising purposes.
Photographer is not responsible for any injuries inflicted upon any participating parties. Client(s) will be responsible for their children and for themselves and release photographer from any claims against their person or their business.
Use of Images
Trish Meadows Photography reserves the right to use any images created during the event for advertising, display, entry in photographic contest or art exhibitions, editorial/commercial use or other purposes. The event may be posted on www.trishmeadowsphotography.com website with samples from the event/session and/or used for promotional and marketing materials. Should the client not wish to have their event uploaded to the internet for viewing or a sample placed on the website or used in marketing materials, a request must be made prior to the event in writing.
The Client is obtaining prints for personal use only, and shall not sell said prints. If Client is obtaining a print for newspaper announcement of an engagement or wedding, editorial use or website, Photographer authorizes Client to reproduce the print in this manner. In such event, Client shall run a credit for the Photographer adjacent to the photograph.
Copyright & Penalty
Trish Meadows Photography retains all copyrights to all images created during client’s session. A print release may be purchased with digital files to print portraits for personal use up to designated size listed on print release. The print release does not allow publication of your portraits (i.e. entering in contests), selling or altering of your images without written consent of Trish Meadows Photography. It is illegal to copy, scan, download, print, share, or alter any image created by Trish Meadows Photography. This applies to "sneak peek" images, images posted in an online proofing gallery, blog, or hard copy images. Clients may share, tag, and repost Facebook images on their own Facebook page only. It is ILLEGAL to copy or reproduce these photographs without the photographer’s permission, and violators of this Federal Law will be subject to its civil and criminal penalties. Exception: client may use watermarked, web-size, low-resolution images received/purchased on session disk for online sharing.
